1. Who these terms are with
This website is operated by AverageGamesStudio I/S, Interessentskab (I/S) — Danish general partnership, L.A. Rings Vej 145, 3. tv, 5230 Odense M, Denmark. CVR 43415638, EU VAT DK43415638, registered 30 July 2022. Contact: info@averagegamesstudio.com. Using this site means these terms apply between you and us.
2. What this website is
It is an information site about our game publishing services and the titles we have worked on, plus two forms for getting in touch. Nothing is sold through this site. There is no shop, no checkout, no subscription and no download for sale here, and we take no payment details on it.
3. Submitting a pitch
The pitch portal is an invitation to submit material for assessment. Submitting is free, and submitting creates no contract, no obligation on us to publish, fund or reply in any particular way beyond our stated commitment to answer in writing, and no exclusivity in either direction.
You confirm that you have the right to send us what you send, and that it does not infringe anyone else’s rights. You keep the intellectual property in your game — sending us a pitch transfers nothing. We use the material only to assess the submission and to reply to you.
If you need confidentiality in place first, ask us for an NDA before you send anything, at info@averagegamesstudio.com. Without a signed NDA, please do not send us material you cannot afford to have read without one — and be aware that ideas, genres and mechanics are not protectable in themselves, and that we may already be working on something similar.
4. Funding — what a publishing advance is and is not
Where we fund part of a production, that funding is commercial consideration under a publishing agreement, financed from the company’s own capital and recouped from the revenue of the title on the terms of that agreement.
It is not a loan, a credit facility, a deposit, a security, a share, a fund, a public offering, crowdfunding, or an investment of any kind. We do not accept money from the public, we offer no financial return to anyone, and nothing on this site is financial advice or an offer of a financial product or service. Any funding arrangement exists only in a signed written agreement between the two companies concerned.
5. Platform approvals, ratings and outcomes
We prepare, file and manage submissions to storefronts and console platform holders and applications to age rating boards. The decisions belong to them. We do not represent that any platform holder has approved a title in advance, and we give no guarantee of a release date, a rating, coverage, wishlist numbers, revenue or sales. Any figure we discuss with a developer is a plan, not a promise.
6. Trademarks
Platform, storefront and event names used on this site — including Steam, PlayStation, Xbox, Nintendo Switch, App Store, Google Play, Gamescom, PAX and Steam Next Fest — are trademarks of their respective owners. We use them descriptively, to say which platforms we submit to and which events we attend. We are not affiliated with, sponsored by or endorsed by any of them.
7. Our own content
Text, layout, generated artwork and code on this site belong to AverageGamesStudio I/S unless stated otherwise. Game titles, storefront listings and any third-party material remain the property of their respective owners, and where a title is built on community-licensed material the licence is stated on that title’s page.
8. Accuracy and availability
We keep this site accurate and correct mistakes when we find them, but we do not warrant that it is free of errors or always available. Catalogue entries reproduce public storefront listings as at the date shown on the catalogue page; the storefront itself is the authoritative record.
9. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited under Danish law. Subject to that, we are not liable for indirect or consequential loss, or for loss of profit, revenue, data or goodwill, arising from use of this website. A publishing relationship, if one is entered into, is governed by its own written agreement and not by this page.
10. Complaints and disputes
If something goes wrong, write to info@averagegamesstudio.com and we will deal with it directly — that is the first and fastest route. These terms are governed by Danish law and the courts of Denmark have jurisdiction. As no goods or services are sold to consumers through this website, consumer alternative-dispute-resolution schemes do not apply to it.
11. Privacy and cookies
How we handle personal data is set out in the Privacy Policy, and browser storage is covered in the Cookie Policy.
12. Changes
We may update these terms. The version in force is the one published here, with the date shown at the top.
